Supplementary terms and conditions for the Online Trade / Online Shop
On the basis of these supplementary terms and conditions for the online trade / online shop and our general terms and conditions (AGB), the contract is concluded between the customer and ESplan GmbH represented by Margarete Bannert (hereinafter referred to as provider).

This agreement regulates the sale of new goods and services from the area / areas of 3D printer systems, CAE software via the provider’s online shop. Due to the details of the respective offer, please refer to the product description of the offer page.
The contract is concluded in the electronic business via the shop system or via other means of telecommunication such as telephone and e-mail. The offered offers represent a non-committal invitation to the submission of an offer by the customer order, which can then be accepted by the supplier. The order process for the contract includes the following steps in the shop system:
– Selection of the offer in the desired specification (size, color, number)
– Insert the offer in the shopping basket
– Pressing the button ‘order’
– Enter the invoice and delivery address
– Selection of the payment method
– Check and process the purchase order and all entries
– Click on the button ‘pay for the order’
– confirmation mail that order has been received Orders can be placed next to the shop system also via remote communication means (telephone / e-mail), whereby the order process for the conclusion of the contract comprises the following steps:
– Call the order hotline / send the order mail

The contract is concluded indefinitely.
The customer has no way to access the stored contract text directly. The customer can correct errors in the input during the ordering process. To do this, he can do the following: Using the “Back Button” in the browser.
The supplier is granted the right to choose between repair or new delivery if the goods are new and the customer is an entrepreneur. If the customer is an entrepreneur, warranty is excluded for second-hand goods. If the customer is a consumer, the warranty period for used goods is limited to one year. This does not apply to claims for damages on the part of the customer due to injury to life, body, health or essential contractual obligations, which must necessarily be fulfilled in order to achieve the contract goal. This also does not apply to claims for damages following gross negligence or willful breach of duty on the part of the supplier or his legal representative or vicarious agents. Otherwise, the statutory provisions apply.
Claims for damages by the customer are excluded, unless otherwise stated for the following reasons. This also applies to the agent’s representatives and vicarious agents, should the customer charge damages against these claims. Exceptions are damages claims of the customer because of injury to life, body, health or essential contractual obligations, which must necessarily be fulfilled to the achievement of the contract goal. This also does not apply to claims for damages following gross negligence or willful breach of duty on the part of the supplier or his legal representative or vicarious agents.
Claims or rights of the customer against the supplier may not be assigned or pledged without his consent, unless the customer has demonstrated a justified interest in the assignment or pledge.
The contract is written in German. The implementation of the contractual relationship takes place in German. The law of the Federal Republic of Germany applies exclusively. For consumers, this applies only to the extent that this does not restrict the statutory provisions of the state in which the customer is domiciled or habitually resident. Jurisdiction is in the case of disputes with customers who are not a consumer, a legal person of public law or a public-law special fund.
In connection with the initiation, conclusion, processing and repackaging of a purchase contract on the basis of these terms and conditions, the provider collects, stores and processes data. This is done within the framework of the legal provisions. The supplier does not pass on any personal data of the customer to third parties, unless he is legally obliged to do so or the customer has expressly consented beforehand. If a third party is used for services related to the processing of processing processes, the provisions of the Federal Data Protection Act shall be complied with. The data communicated by the customer in the course of the order are processed exclusively for contact within the scope of the contract processing and only for the purpose for which the customer made the data available. The data will only be passed on to the shipping company, which accepts the delivery of the goods according to the order. The payment data are passed on to the credit institution which is responsible for the payment. As long as the vendor takes storage periods of a commercial or fiscal nature, the storage of some data may take up to ten years. During the visit to the internet shop of the supplier, anonymised data, which do not allow conclusions on personal data and also do not intend, in particular IP address, date, time, browser type, operating system and pages visited. At the request of the customer, the personal data will be deleted, corrected or blocked within the framework of the statutory provisions. A free of charge information about all personal data of the customer is possible. The invalidity of any provision of these General Terms and Conditions shall not affect the effectiveness of the other provisions.
